What is Settlement?

Employment Route to ILR
To qualify through employment:

– You need five years of continuous lawful residence, which can include various work routes (Tier 1, Tier 2, Skilled Worker etc).

– Absences must be under six months per year.

– Dependents can apply after meeting the five-year requirement.

Partner Route to ILR
If you’re married to or living with a British citizen or someone with settled status:

– You initially receive 30 months of leave (or 33 if applying outside the UK), followed by another 30-month extension.

– After this period, provided your relationship remains intact, you can apply for ILR.

– While there’s no strict limit on time abroad, demonstrating intent to settle permanently in the UK is essential.

Long Residence Route
For those with:

– 10 continuous years of lawful residence in the UK.

– Absences are allowed up to six months per trip, totaling no more than 18 months over ten years. Since April 2024, different rules apply to calculate the absences.

– Note: Dependents must apply separately after their own ten-year period.
